தொற்றுநோய் காலத்தில் ரோட்டில் சுற்றித் திரிவது நோயைப் பரப்பும் என்ற போலீசாரின் வாதம் அடிப்படையற்றது’ என உயர் நீதிமன்ற மதுரைக் கிளை தெரிவித்தது.

மதுரை, உசிலம்பட்டியைச் சேர்ந்த வின்சென்ட் பாலாஜி தாக்கல் செய்த மனு:-

கொரோனா ஊரடங்கின் போது ஏப்., 28 2020-ல் தடையை மீறி, 'டூவீலரில்' சுற்றித் திரிந்ததாக, உசிலம்பட்டி டவுன் போலீசார் என் மீது வழக்கு பதிவு செய்தனர், அரசின் உத்தரவிற்கு கீழ்ப்படிய வில்லை என்ற பிரிவில் வழக்குப் பதிவு செய்யும் அதிகாரம் போலிசாருக்கு இல்லை.

வழக்குப் பதிய, சம்பந்தப் பட்ட குற்றவியல் நீதித்துறை நடுவர் நீதிமன்றத்தில் அனுமதி பெற வேண்டும் என, இந்நீதிமன்றம் ஒரு வழக்கில் விரிவான வழிகாட்டுதல் பிறப்பித்துள் ளது. அந்நடைமுறை பின்பற்றவில்லை.

மனுதாரர், தொற்று நோயை பரப்பும் வகையில் கவனக்குறைவாக செயல்பட்டார் என வழக்குப் பதியப்பட்டுள்ளது. அவர் வெறுமனே ரோட்டில் சுற்றித் திரிந்துள்ளார். கடுமையான குற்றத்தில் ஈடுபடவில்லை.

சம்பவத்தின்போது 144 தடை உத்தரவு அமலில் இருந்திருந்தாலும், வீட்டிற்குள் செல்லுமாறு மனுதாரரை போலீசார் எச்சரித்திருக்க வேண்டும். அதற்கு பதிலாக வழக்கு தொடர்ந்துள்ளனர்.

தொற்றுநோய் காலத்தில் ரோட்டில் சுற்றித் திரிவது நோயைப் பரப்பும் என்ற போலீசாரின் வாதம் அடிப்ப டையற்றது.

திட்டமிடப்படாத சாதாரண செயல், மனுதாரரின் எதிர்காலத்தை பாதிக்கக் கூடாது. தொற்றுநோய் காலத்தில், மக்களுக்கு எதிராக பதிவு செய்யப்பட்டுள்ள வழக்கு களை அரசு கைவிடப்போவதாக இந்நீதிமன்றத்தின் கவனத்திற்கு கொண்டு வரப்பட்டுள்ளது.

The Madurai branch of the High Court said that the police's argument that wandering on the road during epidemics would spread the disease was baseless.

Petition filed by Vincent Balaji of Usilampatti, Madurai: -

The Usilampatti Town police filed a case against me for violating the ban on April 28, 2020 during the Corona curfew and roaming around in a 'two-wheeler'.

The court has issued detailed guidelines in one case, seeking permission from the relevant criminal justice arbitral tribunal to prosecute. The procedure was not followed.

I have no intention of spreading the infection to others I just wandered around and the case should be dismissed thus stated.

The petitioner is alleged to have acted negligently in spreading the disease. He is simply wandering around on the road. Not involved in serious crime.

Although 144 restraining orders were in force at the time of the incident, the police should have warned the petitioner to enter the house. Instead they are suing.

The police's argument that wandering on the road during an epidemic spreads the disease is untenable.

The unplanned normal action should not affect the future of the petitioner. It has been brought to the notice of this Court that the Government will drop the cases registered against the people during the epidemic.
